Welcome to Phloat ("Phloat", "we", "us"). Phloat lets you back up your photos and videos to the cloud, keep your library across iOS, Android, and the web, and share albums with others. By creating an account or using Phloat, you agree to these Terms and to our Acceptable Use Policy below.
You're responsible for activity under your account and for keeping your sign-in secure. Phloat is for your personal use. You must be old enough to form a binding contract in your jurisdiction (and at least 13, or older where required).
You keep all rights to the photos, videos, and other content you upload ("Your Content"). We claim no ownership. You grant us only the limited license needed to store, process, back up, and transmit Your Content so we can provide the service — including generating thumbnails and previews, and delivering content to people you choose to share it with.
We do not sell Your Content, use it for advertising, or use it to train AI models. See our Privacy Policy for how we handle your data. You're billed only for the originals you store — never for the thumbnails and previews we generate to make browsing fast.
You are responsible for Your Content and for anything you share. You agree not to upload, store, or share content that:
When you create a share link, it is unlisted — not searchable or indexed — but anyone who has the link can view the album. You are responsible for who you give a link to. Only verified accounts (signed in with Apple or Google) can create public share links, for accountability. Anyone viewing a shared album can report it to us. We may disable or remove any shared content, or the link to it, at our discretion — especially where it violates this policy.
We may remove content, disable share links, or suspend or terminate accounts that violate these Terms. We operate a report mechanism for shared albums and review reports we receive.
Copyright (DMCA): if you believe content on Phloat infringes your copyright, send a notice to our designated agent at abuse@phloat.app including the information required under the DMCA. We respond to valid notices and terminate repeat infringers.
Phloat offers a free tier and paid storage plans. Paid plans are auto-renewing subscriptions billed through the Apple App Store or Google Play under their terms; manage or cancel them in your store account. If a plan ends or a payment fails, your storage limit returns to the free tier, and content over the limit may become unavailable until you're back under it or free up space. Refunds are handled by the app store per its policies.
You can stop using Phloat and delete your account at any time; deleting your account removes your stored content on our systems (subject to a short recovery window and legal-hold requirements). We may suspend or end access for violations of these Terms.
Phloat is provided "as is." While we work hard to keep your library safe and available, we don't guarantee the service will be uninterrupted or error-free, and it is not a substitute for keeping your own additional backups of irreplaceable content. To the fullest extent permitted by law, our liability arising from the service is limited, and we are not liable for indirect or consequential damages.
We may update these Terms as Phloat evolves. We'll post the updated version here and, for material changes, give reasonable notice. Continuing to use Phloat after changes take effect means you accept them.
